Winners will be notified by email. If a winner is unreachable after two (2) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If tbt*/St Pete Times/TampaBay.com cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
Automated voting of any kind is not allowed. Detection of said automated voting will lead to votes being voided.
tbt*/St Pete Times/TampaBay.com reserves the right to substitute any prize with another prize of equal or greater value.
tbt*/St Pete Times/TampaBay.com reserves the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of tbt*/St Pete Times/TampaBay.com, its respective parent, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to tbt*/St Pete Times/TampaBay.com the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.

Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.

This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.

These rules are for the ULTIMATE BARTENDER CONTEST (“the Contest”). Entries will be accepted beginning on May 4, 2009 and ending on May 21, 2009. Round 1 votes will be accepted beginning on May 22, 2009 and ending on June 4, 2009. The top 5 vote-getters in Round 1 will advance to Round 2. Round 2 votes will be accepted June 5, 2009 to June 21, 2009. Entry into and/or voting in the Contest constitutes the entrant’s and/or voter’s full and unconditional agreement to and acceptance of these rules, terms and conditions.
ELIGIBILITY
The Contest is open to legal residents of the United States and Florida who reside in one of the following Florida counties: Hillsborough, Pasco, Pinellas, Hernando, Polk, and Citrus. Eligible entrants will have reached their 21st birthdays on or before May 21, 2009. Date of birth must be verified by an official document (such as a driver’s license, passport or birth certificate) and a photo ID of the entrant. Past winner’s of tbt*s Ultimate Bartender Contest are not eligible to enter or win. Employees of the Times Publishing Company, its affiliates and subsidiaries, advertising and promotion agencies, contest prize suppliers, and participating advertisers and their immediate family members are not eligible to enter or win. “Immediate family members” means parents, siblings, spouses, children, grandparents and grandchildren, whether by current or past marriage, remarriage, adoption or cohabitation, and anyone living in the same household, whether related or not. Times Publishing Company’s determination as to eligibility is final and binding.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. Purchase will not improve changes of winning.
HOW TO ENTER
Each participant must register at at tbt.com or complete this form in its entirety.
No other method of entry will be accepted. All information provided at the time of entry must be accurate and all required data fields in the entry form must be complete, including a valid email address of which the entrant is the authorized account holder at the time of entry. “Authorized Account Holder” means the person to whom the email address is assigned by an Internet access or on-line service provider, or other organization (such as a business or educational institution) that is responsible for assigning email addresses for the domain name associated with the email address submitted.
To enter, the entrant must submit a personal photograph taken within the previous 12 months or allow a new photo to be taken. Each entrant must enter personally and must have full authority to provide the photograph for publication. Any entry submitted by or on behalf of another person will be disqualified. Any photograph depicting nudity or other bodily exposure considered indecent by the Sponsor will be disqualified, including rear-views of thongs. Links to websites unaffiliated with the Sponsor or the posting a telephone numbers will not be accepted. Violators of these conditions may be banned from participation of any kind in the contest.
Incomplete entries are void and ineligible to compete or win. The odds of winning depend on the number of eligible entries received and the number of votes submitted. The Times Publishing Company is not responsible for lost, late, incomplete, misdirected, garbled, jumbled, damaged or illegible entries or votes, for any computer, electronic, telephone, cable, or network hardware or software malfunction or failures of any kind, for any other problems or errors in modes of transmission, or for any other human or technical error.
Uploading a photo or agreeing to be photographed by tbt* photographer constitutes Entrant’s permission to use his or her name and likeness for publicity purposes without compensation.
By entering the contest, Entrant gives Sponsor permission to use his or her contact information to contact him or her concerning the contest, or concerning goods or services offered by Sponsor.
HOW TO VOTE FOR THE WINNER
Every on-line voter must be the Authorized Account Holder, as defined above, of the email address submitted at the time of voting. Times Publishing Company’s determination as to voter eligibility is final and binding. Visitors to the website, as determined by their IP address, can vote once per 24 hour period. The use of any scheme, program or device to automate voting is prohibited. Any attempt by any voter to tamper with or undermine the legitimate operation of the Contest or tally of votes will, in the Sponsor’s sole discretion, result in the disqualification of the entrant and of any suspect votes. The Sponsor reserves the right to disqualify any entrant or vote, and to modify, cancel, terminate or suspend voting or the Contest. Decisions of the Sponsor are final and binding.
HOW TO WIN
The five Entrants who have received the highest ratings as determined by the database vote tally as of 11:59 p.m. EDT on June 4, 2009, will be entered into Round 2. The Entrant who has received the highest ratings as determined by the database vote tally as of 11:59 p.m. EDT on June 21, 2009 will be declared the Winner. The Winner will be notified by the telephone number or email address provided at the time of entry.
The Winner will appear on the cover of tbt*s Ultimate Bar Guide on June 26, 2009. By entering the Contest, Entrant understands that he or she will be expected to pose for the cover photo without compensation. There are no guarantees of any future work, opportunities, or endorsements. Entrant releases Sponsor from any and all claims for injuries or damages of any kind that may occur as a result of Entrant’s appearance on Sponsor’s website or the cover.
If the Winner does not respond to the notification within two days, or if the Winner does not meet eligibility requirements, including (1) availability to participate in a photo shoot with a photographer of Sponsor’s choice on June 22 through June 24, 2009 and (2) signing the Affidavit and Release referred to below, the Winner forfeits, and the entrant with the next highest rating will be declared the Winner.
PRIZE:
THERE IS NO PRIZE. Entrants are not being offered any cash, goods, services or any other thing of value as a “prize” in connection with the Contest, and no compensation of any kind will be earned by participating or winning. The Contest is solely a “popularity” contest. Use of any Times Publishing Company tradename, trademark, brand or any other intellectual property is not authorized by entry into or winning of the Contest. Any such authorization must be obtained separately and in writing, signed by a Company officer.
AFFIDAVIT AND RELEASE
The Winner will be required to sign and return an Affidavit of Eligibility and General Release, which includes an affirmation of eligibility, a release and waiver of legal claims, and a consent to publicity. The failure to complete and sign the Affidavit of Eligibility and General Release will result in another entrant being selected as the winner.

ADDITIONAL TERMS AND CONDITIONS
All federal, state, and local laws and regulations apply. Void where prohibited by law.
By entering or voting in the Contest, the entrant or voter, for him/herself and for his/her heirs, executors, administrators, assigns and anyone else claiming by or through him/her, waives, covenants not to sue and fully releases and forever discharges any and all rights, claims or causes of action whatsoever that he/she may have against Sponsor arising directly or indirectly out of entrant’s or voter’s participation in the Contest. For purposes of this waiver and release, “Sponsor” includes Times Publishing Company and its parents, subsidiaries, affiliates, officers, directors, agents and employees. This waiver and release covers, without limitation, any damage, liability, cost, attorneys’ fees and expenses whatsoever, whether known or unknown and whether foreseeable or not.
Sponsor reserves the right to make changes in the rules of the contest. Any changes will become effective upon announcement.
Sponsor is not responsible for typographical, electronic or other errors in printing, the offering, or the administration of the contest or in the announcement of the winner.

The Sponsor of the Contest is Times Publishing Company, 490 First Avenue South, St. Petersburg FL 33701. Copies of the written contest rules are available online or will be sent by mail request if request is accompanied by a self-addressed, stamped envelope.
