Official Rules
 
These rules are for Newspaper in Education’s, Tampa Bay’s Cutest Kid Contest (“the Contest”), starting October 11, 2010 at 12:01 a.m. EST and ending November 14, 2010 at 11:59 p.m. EST. Entry into the contest constitutes the entrant’s full and unconditional agreement to and acceptance of these rules, terms and conditions. All proceeds from the contest will benefit the St. Petersburg Times Newspaper in Education program.

ELIGIBILITY. To enter a child and/or vote for a child you must have reached your 18th birthday on or before October 11, 2010. Children entered in the contest must be legal residents of the United States and Florida who reside in one of the following Florida counties: Citrus, Hernando, Hillsborough, Manatee, Pasco and Pinellas. All legal residents of the United States are eligible to vote.

Employees of the Times Publishing Company, its affiliates and subsidiaries, advertising and promotion agencies, contest prize suppliers, and participating advertisers and their immediate family members are not eligible to win. “Immediate family members” means parents, siblings, spouses, children, grandparents and grandchildren, whether by current or past marriage, remarriage, adoption or cohabitation, and anyone living in the same household, whether related or not. Times Publishing Company’s determination as to eligibility is final and binding.

HOW TO ENTER. Entries will be accepted beginning on October 11, 2010 at 12:01 a.m. EST and ending October 24, 2010 at 11:59 p.m. Entries may be made by following the Cutest Kid Contest link at tampabay.com/contests. To enter, submit a photo of your child along with all required information and requested $10 entrance fee. Photos must be submitted by a parent, legal guardian18 years or older. Children must have a birth date of January 1, 2000 or later. Times Publishing Company reserves the right to verify proof of age. Child’s name, parents’ or legal guardian(s)’ names, and phone numbers, must be included with all entries. Entries with incomplete or incorrect information will not be accepted. Only one photo per entry per child. Multiple births (twins, triplets, etc.) can be entered as one “contest photo” entry if all of the children are in one photo.

The deadline for receiving entries is October 24, 2010 at 11:59 p.m. EST.

HOW TO VOTE FOR THE WINNER. Voting will begin on October 25, 2010 at 12:01 a.m. EST and end on November 14, 2010 at 11:59 p.m. To cast a vote for your favorite child simply submit a vote along with $1.00. Each $1.00 will count as one vote. Entry into and/or voting in the Contest constitutes the entrant’s and/or voter’s full and unconditional agreement to and acceptance of these rules, terms and conditions.

Every online voter must be the authorized account holder of the email address submitted at the time of voting. “Authorized account holder” means the person to whom the email address is assigned, Times Publishing Company’s determination as to voter eligibility is final and binding. Online voters may vote only one time each day. The use of any scheme, program or device to automate voting is prohibited. Any attempt by any voter to tamper with or undermine the legitimate operation of the Contest or tally of votes will, in Times Publishing Company’s sole discretion, may result in the disqualification of the band entrant and any suspect votes. Times Publishing Company reserves the right to disqualify any entrant or vote, to modify, cancel, terminate or suspend voting or the Contest. Decisions of the Sponsor are final and binding.

The contestant with the highest number of votes will be named the winner.

Times Publishing Company is not responsible for lost, late, misdirected, damaged, illegible, or any electronic malfunction. Times Publishing Company is not responsible for any other problems or errors in modes of transmission of entries.

All entries become the property of Times Publishing Company. Each Entrant acknowledges and agrees that Times Publishing Company may use information submitted to contact Entrant and/or to offer products or services.

PRIZES. The following Contest prizes will be awarded: One (1) Grand Prize winner will receive $500 cash and the opportunity to appear on the cover special section on November 26th. Four (4) top runner-up winners will also be featured in the insert. Value of the Grand Prize Package: $500. Value of each runner-up prizes: $0. Total Value of All Prizes: $500.

No alternative prize, cash or other substitution is permitted except in the event of prize unavailability. Sponsor reserves the right to substitute a prize or prizes of equal or greater value. Prizes are not transferable or assignable by the Winners.

All federal, state and local taxes, fees, and surcharges, and any necessary or appropriate insurance, are the responsibility of the Winner. Winner agrees to pay all such taxes, fees, and surcharges and is responsible for furnishing proof of insurance if and as required by law. If requested, each Winner must complete a W-9 tax form provided by the Times Publishing Company prior to taking possession of the Prize. Any transportation required for a Winner to take possession of the Prize is the Winner’s responsibility and will not be furnished by the Sponsor. Winner must agree to hold the Sponsor harmless from any and all liability for damages or losses of any nature incurred in connection with use of the Prize, including transit to and from any destination in connection with the Prize.

WINNER SELECTION AND NOTIFICATION. Winner will be selected on November 14, 2010. The winner will by determined by total votes only. In the event of a tie, Times Publishing Company will randomly pick the winner from the tied entries. The child receiving the highest number of votes will be the First Place Winner, the second highest numbers of votes will be the Second Place Winner, the third highest number of votes will be the Third Place Winner, the fourth highest number of votes will be the Fourth Place Winner, and the fifth highest number of votes will be the Fifth Place Winner.

The winners will be notified by email and/or phone on or before November 16, 2010. If a Winner does not respond to the notification within twenty-four hours, or Winner does not meet all eligibility requirements including signing the Affidavit and Release referred to below, an alternate winner will be selected. Alternate winners will be selected by highest number of votes and will go in order of 1st, 2nd, 3rd, 4th and so on. Winner must produce adequate proof of identity, such as a driver license or photo I.D. card, in order to take possession of the Prize.

AFFIDAVIT AND RELEASE. Winner will be required to sign and return an Affidavit of Eligibility and General Release, which includes an affirmation of eligibility, a release and waiver of legal claims, and a consent to publicity. Failure to complete and sign the Affidavit of Eligibility and General Release will result in forfeiture of the prize and its award to another winner chosen by highest number of total votes.

WINNER’S LIST. For a list of prize winners, send a self-addressed stamped envelope before December 22, 2010 to: Cutest Kid Contest, Newspaper in Education, P.O. Box 150, St. Petersburg, FL 33731-9925.

ADDITIONAL TERMS AND CONDITIONS. All federal, state, and local laws and regulations apply. Void where prohibited by law. By entering the Contest, the entrant, for him/herself and for his/her heirs, executors, administrators, assigns and anyone else claiming by or through him/her, waives, covenants not to sue and fully releases and forever discharges any and all rights, claims or causes of action whatsoever that he/she may have against Sponsor arising directly or indirectly out of entrant’s participation in the Contest. For purposes of this waiver and release, Times Publishing Company includes its parents, subsidiaries, affiliates, officers, directors, agents and employees. This waiver and release covers, without limitation, any damage, liability, cost, attorneys’ fees and expenses whatsoever, whether known or unknown and whether foreseeable or not.

Times Publishing Company reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.

Times Publishing Company is not responsible for typographical or other errors in printing, the offering, or the administration of the contest or in the announcement of the prize.

SPONSOR. The Sponsor of the Contest is Times Publishing Company, 490 First Avenue South, St. Petersburg FL 33701. Copies of the written contest rules are available online or will be sent by mail request if a self-addressed stamped envelope accompanies request.

UPICKEM and Times Publishing Company/ Newspaper in Education/St Petersburg Times/TampaBay.com are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.

This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
