IIFA Stomp Dance Contest

These rules are for the IIFA Stomp Dance Contest (“the Contest”). Entries will be accepted from Wednesday, March 12, 2014, at 12:00 AM ET and ending at on Wednesday, April 9, 2014 at 11:59 PM ET. Votes will be accepted beginning at 12:00 AM ET on April 10, 2014 and ending at 11:59 PM ET on April 16, 2014. Entry into and/or voting in the Contest constitutes the entrant’s and/or voter’s full and unconditional agreement to and acceptance of these rules, terms and conditions.

HOW TO ENTER

NO PURCHASE NECESSARY TO ENTER TO WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.  Only one (1) entry per person shall be permitted.  There is only one way to enter this Contest. 

Each entry must registered at www.tampabay.com/iifa completing all of the required information and following all posted instructions to upload a digital video showcasing yourself or your group performing a Bollywood-style dance (the “Entry Materials”). Each team may have a minimum of one and a maximum of ten (10) participants. Video file cannot exceed 200MB in size; video cannot be longer that two (2) minutes and must be in one of the following formats: avi, dv, mov, qt, mp4, mpeg, 3gp, asf, wmv or mpg. Videos shall NOT contain: nudity, lewd or vulgar behavior, offensive language and/or gestures. All entries must be appropriate for all audiences. Any video that includes content that is deemed inappropriate, indecent or obscene, as determined by the Sponsor in its sole discretion, will not be eligible.

All entries must be received by April 9, 2014 at 11:59 PM ET.  Incomplete entries are void and ineligible to compete or win. The odds of winning depend on the number of eligible entries received and the number of votes submitted.

Entry Materials that do not comply with these Rules shall be disqualified. Sponsor reserves the right to prohibit any Entrant from participating in the Contest if, at its sole discretion, Sponsor finds such Entrant to be tampering with the entry process, the voting process, or the operation of the Contest, or if such entrant repeatedly shows a disregard for, or attempts to circumvent, these Official Rules, or acts: (a) in a manner the Sponsor determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsor; or (c) in any other disruptive manner.

Incomplete or late entries will be disqualified and the IIFA International Indian Film Academy (“Sponsor”) shall not be responsible for lost, late, incomplete, misdirected, garbled, jumbled, damaged, deleted, misdirected as a result of technical, internet, server, or other online difficulties, or illegible entries or votes, for any computer, electronic, telephone, cable, or network hardware or software malfunction or failures of any kind, for any other problems or errors in modes of transmission, or for any other human or technical error.

In the event of a dispute regarding the identity of an entrant, the holder of the e-mail account will be deemed the person who submitted the entry. Limit one entry per person. Subsequent entries from the same email address will be deleted. Multiple entries from the same person will be disqualified. All entry information becomes the property of Sponsors and will not be returned or its receipt acknowledged.

All entries become the property of the Sponsor and will not be returned. Each Entrant acknowledges and agrees that Sponsor may use information submitted to contact Entrant and/or to offer Sponsor’s products and services.

The video and dance must be an original own performance. The entry must not include any other entity’s brand name, logo, company name, trademark, service mark, copyrighted material, or material that is in any way proprietary to another entity. There will be only one entry per person or dance group. You must have a valid e-mail account in order for your entry to be eligible. Sponsors reserve the right to disqualify those entries that may subject Sponsors to a claim or litigation. 

ADDITIONAL TERMS AND CONDITIONS

By entering, you on behalf of yourself and your dance group, if applicable, you represent that the Entry Materials (i) consists of your own performance (ii) do not/will not violate or infringe any intellectual property rights, including but not limited to copyright, trademark/trade name, or contract rights, or any other proprietary rights of any person or entity and the video is the exclusive property of Entrant; and (iii) in no other way violate any applicable laws, regulations, or television broadcast network standards as determined by Sponsors in their sole discretion.

By entering the Contest, the entrant, for him/herself and for his/her heirs, executors, administrators, assigns and anyone else claiming by or through him/her, waives, covenants not to sue and fully releases and forever discharges any and all rights, claims or causes of action whatsoever that he/she may have against Times Publishing Company or the Sponsor arising directly or indirectly out of entrant’s participation in the Contest. For purposes of this waiver and release, “Sponsor” includes the IIFA International Indian Film Academy and its parents, subsidiaries, affiliates, officers, directors, agents and employees.  This waiver and release covers, without limitation, any damage, liability, cost, attorneys’ fees and expenses whatsoever, whether known or unknown and whether foreseeable or not.

Sponsor reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement.

Sponsor is not responsible for typographical or other errors in printing, the offering, or the administration of the contest or in the announcement of the prize.  

ELIGIBILITY

Contest is open only to U.S. citizens who are legally resident in Pinellas, Hillsborough, Citrus, Pasco, Hernando, and Manatee counties and who are at least 18 years or older (including each member of the dance group, if applicable) as of March 12, 2014. Employees of the Sponsor, Times Publishing Company, its affiliates and subsidiaries, advertising and promotion agencies, contest prize suppliers, and participating advertisers and their immediate family members are not eligible to win. “Immediate family members” means parents, siblings, spouses, children, grandparents and grandchildren, whether by current or past marriage, remarriage, adoption or cohabitation, and anyone living in the same household, whether related or not. Times Publishing Company’s determination as to eligibility is final and binding

HOW WINNERS WILL BE SELECTED:

Winners will be selected two ways:

(1) People’s Choice Winner - beginning on April 10, 2014 at 12:00 AM ET and ending on April 16, 2014 at 11:59 PM ET votes will be accepted for the favorite Bollywood-style dance performance. Entry into and/or voting in the Contest constitutes the entrant’s and/or voter’s full and unconditional agreement to and acceptance of these rules, terms and conditions.

Every online voter must be the authorized account holder of the email address submitted at the time of voting. “Authorized account holder” means the person to whom the email address is assigned. Times Publishing Company’s determination as to voter eligibility is final and binding. Online voters can have one vote per person per day in a 24 hour period. The use of any scheme, program or device to automate voting is prohibited. Any attempt by any voter to tamper with or undermine the legitimate operation of the Contest or tally of votes will, in the Sponsor’s sole discretion, result in the disqualification of the Entrant and any suspect votes. The Sponsor reserves the right to disqualify any entrant or vote, or to modify, cancel, terminate or suspend voting or the Contest. Decisions of the Sponsor are final and binding.

(2) Judge Selection Winner – IIFA staff will select one (1) winner based on the following judging criteria: overall dance performance, creativity and difficulty of dance and technical proficiency of dance performance. The decisions of the judges are entirely their own.

PRIZES:

The following Contest prizes will be awarded to the winning dance teams. There will be two (2) prize winning teams. Each winning team will receive the opportunity to perform at the IIFA Stomp event on April 23, 2014 in Tampa and will receive tickets to IIFA Magic of the Movies and Technical Awards on April 25, 2014 for up to 10 members. Total value of the prize is $150 per person.

NOTIFICATION OF WINNER

Winners will be notified by email and/or phone. If the Winner does not respond to the notification within two (2) business days following the day contact is first attempted or Winner does not meet all eligibility requirements including signing the Affidavit and Release referred to below, an alternate winner, will be selected as determined by the database vote tally and or judge selection. Winners must produce adequate proof of identity, such as a driver license or photo I.D. card, in order to take possession of the Prize.

HOW TO CLAIM A PRIZE

Winner will be required to sign legal documents or provide additional proof of eligibility. Specifically, Winner must complete an affidavit of eligibility, which releases Sponsor, its affiliates, and prize suppliers from any and all liability related to this Contest or use or acceptance of the prize. Winners must complete the affidavit of eligibility, without making changes, and return the properly completed and notarized affidavit for receipt by Times Publishing Company within three (3) days of the date the winner received prize notification. Failure of Times Publishing Company to receive a properly executed affidavit within three (3) days of winner notification will result in disqualification and forfeiture of prize. Alternate winner is subject to all requirements and limitations in these Official Rules. Prize will be mailed via signature receipt to winner at the address provided on winner’s entry into Contest.  By accepting a prize, the winner agrees to allow the use of his or her name, voice, photograph, likeness and any information provided on the entry form, (in any media now known or hereafter invented) and for any purpose, including advertising, promotional or other purposes, by Times Publishing Company and its affiliates, without further compensation.

PRIZE RESTRICTIONS

No alternative prize or other substitution is permitted except in the event of prize unavailability, in which case Sponsor reserves the right to substitute a prize or prizes of equal or greater value.  Prizes are not transferable or assignable by the Winner.

Winner is responsible for any charges not specifically listed as part of the prize or to redeem or make use of prize, including transportation to and from any destination in connection with taking possession of or using the Prize, and any and all taxes, if any. All federal, state and local taxes, fees, and surcharges, and any necessary or appropriate insurance, are the responsibility of the winner. Winner agrees to pay all such taxes, fees, and surcharges and is responsible for furnishing proof of insurance if and as required by law. The winner must complete a W-9 tax form provided by Times Publishing Company prior to taking possession of the Prize. Winner must agree to hold the sponsor harmless from any and all liability for damages or losses of any nature incurred in connection with use of the prize, including transit to and from any destination in connection with the prize.

MISCELLANEOUS

Contest rules shall be governed and enforced pursuant to Florida law, excluding choice of law provisions. All other federal, state, and local laws and regulations apply. Void where prohibited by law.  Entrants agree to be bound by these rules. Sponsor is entitled to interpret these rules as needed and their decisions are final. Sponsor reserves the right to correct typographical, clerical or printing errors in any Contest materials. Any person attempting to defraud or in any way tamper with the secure operation of this Contest will be disqualified and ineligible to win. Sponsor reserves the right to terminate or cancel this Contest at any time in such circumstances. In such circumstances, the Prize will be awarded based on entries received as of the date of termination.
